In the latest move in this ongoing patent dispute between these two companies, 3Shape is claiming Align infringes on patents related to focus scanning, color scanning, infrared imaging, and motion sensing.
3Shape made the most recent move in the company's ongoing patent dispute with intraoral scanning rival Align Technology with new claims of infringement on four 3Shape patents.
In a complaint filed in the United States District Court for the Western District of Texas, 3Shape asserts that Align Technology's iTero Element intraoral scanner infringes four 3Shape patents related to focus scanning, color scanning, infrared imaging, and motion sensing.
3Shape is asking the court to provide both monetary damages and injunctive relief based on the claims that Align is illegally using patented technologies developed for 3Shape's TRIOS scanners. The two companies have been engaged in a court battle over intraoral scanning technologies for several years with both sides claiming infringement by the other and 3Shape actively seeking to invalidate several of Align's intraoral scanning related patents.
